Section 8
Cannot apply for Damasahi action
: (1) Notwithstanding anything written in Section 4, no application can be made to the court for Damasahi action without obtaining the prior approval of the following officer in relation to the following companies:-
(a) In the case of banks or financial institutions engaged in banking and financial transactions, of Nepal Rashtra Bank (b) In the case of an insurance company doing insurance business, the insurance committee constituted under the Insurance Act, 2049, or (c) In the case of a company that cannot be dissolved voluntarily without the approval of an authorized body or officer in accordance with prevailing laws, except as written in clause (a) or (b), of such officer.
(2) In relation to the company mentioned in sub-section (1), when applying for the action related to marriage, the officer mentioned in that sub-section shall submit a copy of the approval given for that purpose along with the application.
